Slaying a mankind


Surah Baniii ‘Israaa-‘iil (The Children of Israel) - 17

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.
(I seek refuge in God from Satan the outcast)

Bis-Millaahir-Rah-maanir-Rahiim.
(In the name of God, the Beneficent, the Merciful)

وَلَاتَقْتُلُوا۟ ٱلنَّفْسَ ٱلَّتِى حَرَّمَ ٱللَّهُ إِلَّا بِٱلْحَقِّ وَمَن قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِۦ سُلْطَٰنًا فَلَا يُسْرِف فِّى ٱلْقَتْلِ إِنَّهُۥ كَانَ مَنصُورًا 33 

33.  And slay not the life which Allah hath forbidden save with right. And whoso is slain wrongfully, We have given power unto his heir, but let him not commit excess in slaying. Lo! he will be helped.
33.  Wa  laa  taqtulun-nafsal-latii  harramAllaahu  ‘illaa  bil-haqq.  Wa  man-  qutila  mazluuman  faqad  ja-‘alNaa  li-waliyyihii  sultaanan-  falaa  yusrif-fil-qatl. ‘Innahuu  kaana  mansuuraa.
       
Commentary

It has been commanded in this verse that killing a mankind is forbidden by Allah Almighty. None should slay any other, but only in the form; when the violence of the oppressor is proved. Punishment of homicide is only; either in the law of retaliation or for those who are guilty of adultery while they are married or who have been renegades from Islam.

Then it is commanded that the person who is slain being wrongfully, his heir is empowered by the Religious Law that he should sue against the murderer for blood money, and after the decision of the ruler, the Government should slay him. Hiding the bloodshed, having the killer released by giving a bribe or violating the Justice in any form is legally forbidden. Moreover, killing with pains, for example, cutting limbs etc. or killing by tormenting is also forbidden.

“Being helped” means that it is incumbent to every individual that they should help the heir of the slain person in retaliating with justice.

It is known from this verse that any person should not take revenge himself because there is a risk in it that he can cross the line at the time of retaliating and can be guilty of violence himself. The person who feels danger for his life and kills any other, his heirs can also claim on it so that it may be proved in the court that in fact it was violence of the killed person and actually the killer slew him to save own life.
